Terms of Use

1. Acceptance

By accessing or using optimalnourish.com (the "Service") you agree to these Terms of Use, the Privacy Policy, the Cookie Policy, and the Medical Disclaimer, each incorporated by reference. If you do not agree, do not use the Service.

2. Who we are

The Service is operated by OptimalNourish, California, USA ("OptimalNourish", "we", "us"). Contact: hello@optimalnourish.com.

3. Eligibility

You must be at least 18 years old to use the Service or to provide any personal information. If you are under 18, use the Service only with the involvement of a parent or guardian.

4. The Service

OptimalNourish is an educational tool that produces a general, personalised supplement timing schedule and related guidance, and offers an optional paid export of that schedule as a PDF. The Service is informational only. See the Medical Disclaimer.

5. Email and communications

If you provide your email, we use it to deliver your schedule and, where you have consented, occasional educational guides. You can unsubscribe at any time. See the Privacy Policy.

6. Payments

The paid PDF export is a one-off purchase of approximately 9 USD (or the displayed local amount), processed by our payment provider, Stripe. Prices and applicable taxes are shown at checkout. You authorise us and Stripe to charge your chosen payment method. We do not store your full card details.

7. Refunds

Refunds are handled per our Refund Policy.

8. Acceptable use

You agree not to misuse the Service, including: copying, scraping, or republishing our content at scale; reselling the Service or the PDFs; attempting to disrupt or gain unauthorised access to the Service; or using it for any unlawful purpose.

9. Intellectual property

All content, design, text, graphics, the OptimalNourish name and logo, and the compiled data are owned by OptimalNourish or its licensors and are protected by law. We grant you a limited, personal, non-commercial licence to use the Service and your own generated schedule. No other rights are granted.

10. Third-party services and links

The Service relies on third parties (for example Stripe for payments, and email and hosting providers) and may link to external sites. We are not responsible for third-party services or content.

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, OptimalNourish and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or reliance on, the Service or its content. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim, or 100 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless OptimalNourish from claims arising out of your misuse of the Service or breach of these Terms.

14. Changes

We may update the Service or these Terms. Material changes will be posted with a new "Last updated" date. Continued use means acceptance.

15. Termination

We may suspend or terminate access for breach of these Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of the State of California, USA. The state and federal courts located in California have exclusive jurisdiction, subject to any non-waivable rights you have under your local law.

17. Severability and entire agreement

If any provision is unenforceable, the rest remains in effect. These Terms, with the policies referenced, are the entire agreement between you and us regarding the Service.
